Following a successful court battle, the legal firm ALARIUS announces a significant compensation win for direct damages caused during the events related to Russian aggression against Ukraine. This decision marks a significant milestone in protecting the rights and interests of our clients.
In March 2022, an aeroballistic missile struck a commercial and entertainment center, resulting in severe damage and partial destruction of the building.
The Ministry of Defense of the Russian Federation publicly acknowledged that the commercial and entertainment center was hit by the armed forces of the Russian Federation, despite the fact that the facility had no military purpose at the time.
The legal team at Alarius filed a lawsuit, and after careful examination of the case, the court confirmed the existence of damages amounting to €22.5 million. The court ordered the Russian Federation to pay this amount, based on expert reports assessing the overall cost of necessary repair works to restore the building after the missile strike.
An exceptional achievement of the national court in Ukraine was the consideration of the issue of judicial immunity of the Russian Federation and the possibility of applying the "corporate veil" principle. The court concluded that according to international treaties, customary law, and Ukrainian legislation, sovereign judicial immunity does not apply in this specific dispute.
